GENIUS Act Stablecoin Rules Kick In January 18 – 15 Days After the New Congress

The final GENIUS Act stablecoin rules take effect January 18, 2027 – fifteen days after the new Congress is sworn in – and from that date issuing a payment stablecoin in the United States requires a federal or state license, with reserve and redemption standards attached. With the election results in, the countdown is now the stablecoin industry’s fixed point: everything from issuance plans to bank partnerships is being scheduled against a date that no longer moves.

What changes on January 18, 2027

Three months from today, a permitted-issuer regime becomes the only legal way to issue payment stablecoins in the US. The core requirements: at least one-to-one backing by eligible reserve assets, held identifiable and segregated from the issuer’s other assets; monthly public disclosure; no paying interest or yield to holders solely for holding, using or retaining the coin; minimum capital requirements; and an operational backstop calculated from total expenses over the preceding 12 months. The statutory framework also bans algorithmic, non-collateralized stablecoins outright and requires federal licensing for issuers above a $10 billion threshold.

The OCC final rule in plain terms

The Office of the Comptroller of the Currency published its final rule implementing the GENIUS Act on October 21, effective the same January 18 date. One practical escape valve: existing issuers with substantially complete applications pending by that date may request waivers of up to 12 months from the prior-approval requirement – a lane that matters for firms racing the clock. The OCC said it will announce separately when it begins accepting applications and waiver requests. Treasury’s parallel notice of proposed rulemaking and the FDIC’s separate framework – which clarifies that reserve deposits are not insured to stablecoin holders – have been in the pipeline since August.

Why the date lands 15 days after the new Congress

The GENIUS Act (Pub. L. 119-27) took effect on the earlier of 18 months after its July 18, 2025 enactment or 120 days after final implementing regulations – with a hard statutory ceiling of January 18, 2027. The new Congress is sworn in January 3; the rules land two weeks later. The irony of the sequencing is not lost on the industry: the rules were written under one political alignment, and they take force under another. Commentary from industry executives, including TransFi founder and CEO Raj Kamal, framed the period between now and January as the last clean window for issuers to get applications into shape.

What’s still unresolved: market structure

Stablecoins have their rules; market structure does not. The CLARITY Act stalled in the Senate on September 15 after cloture failed 49-50, and with Democrats now holding both chambers it is widely treated as dead until the 120th Congress convenes in January. House Democrats, meanwhile, have been discussing their own market structure bill – an expansion of Rep. Maxine Waters’ Crypto Investor and Consumer Bill of Rights with withdrawal deadlines, custody safeguards, monthly proof-of-reserves reporting and greater SEC oversight – which Republicans have already dismissed as a messaging bill. Stablecoin issuers get certainty in January; everyone else gets an election to watch.
