The crypto industry’s dealmakers did not get the memo about regulatory limbo. Per CoinDesk’s October 4 coverage of CryptoRank Research data, disclosed digital-asset M&A and funding deals reached a record $9.7 billion in the first half of 2026 – a 44% jump versus the same period last year – even as the Clarity Act stalled in the U.S. Senate.

That is the definition of doing business while the referee argues about the rulebook. Undisclosed deal value would push the true figure higher still.

What the Crypto M&A Record Says About Market Confidence

A record half for crypto M&A usually signals two things: dry powder accumulated during the last cycle is being deployed, and strategic buyers see valuation windows worth closing before the next leg up. The timing is notable – the Senate’s cloture vote on the Clarity Act failed 49-50 on September 15 amid disputes over ethics provisions and stablecoin yield rules, with revival odds characterized as very low before the November midterms. Rather than wait for clarity, capital is writing its own.

It also helps explain why institutional plumbing keeps getting built anyway: DTCC’s tokenization service launch and BNB Chain’s $1B tokenized-stock milestone both landed in the past week, and the SEC’s crypto custody proposal is advancing through channels that do not require Congress to agree on anything.

With legislative clarity parked until at least after the midterms, expect M&A to keep flowing toward licensed venues, custody infrastructure and tokenization plays – the categories that can operate under existing statutes. The record $9.7 billion figure makes an argument no lobby deck can: deals are not waiting for Washington, and anyone betting on a clarity-driven freeze has already missed the quarter.
