GENIUS Act Reversal Unlikely in Any Congress, Circle CEO Tells CNBC

Bottom line up front: Circle CEO Jeremy Allaire says GENIUS Act reversal is effectively off the table – even if Democrats retake the House in the 2026 midterms. Speaking to CNBC’s Seema Mody at the Paley International Council Summit on Oct 21, the same day the OCC released its final implementation rules, Allaire called the GENIUS Act "the only major piece of bipartisan legislation" passed in two years. The remarks were recirculating across crypto feeds this week as midterm-driven repeal speculation picked up.

Why Allaire Says Repeal Is Off the Table

The arithmetic, per Allaire: the GENIUS Act passed the Senate 68-30 and the House 308-122, including 102 House Democrats and 18 Senate Democrats voting yes. Repealing the law would require lawmakers to undo their own votes – including many of the Democrats who would control a flipped House. "There may be other areas of crypto that have questions, but I think digital dollars and the role that these play for the United States is going to be something that is important to everybody here," he said.

Why It Matters Now: The OCC Final Rule

Allaire’s reassurance landed the same day the OCC issued its final GENIUS Act rules – 1:1 reserve requirements for permitted payment stablecoin issuers, expedited redemption, custody rules, capital ratios, and a bar on non-permitted issuers issuing payment stablecoins in the US. The framework takes effect Jan 18, 2027, and gives issuers like Circle long-term policy certainty ahead of crypto sectors still awaiting clarity. USDC circulation stood at roughly $73.3 billion in Q2 2026, up 19% year over year. Circle’s stablecoin peers are watching the same calendar – the rule’s yield treatment has already drawn bank-industry complaints about ambiguity.

The Fine Print

Allaire runs the company most exposed to the law he is vouching for – an interested-party assessment worth weighing. His argument also addresses full repeal, not amendment: a flipped House could still pursue tougher oversight, heavier audits or narrower reserve rules without touching the statute itself. And stablecoin politics remain live beyond Congress – a Circle shareholder’s lawsuit over the company’s UAE dealings, which we covered earlier this week, shows how intertwined the issuer has become with Washington’s crypto-political fights.
