OCC Finalizes GENIUS Act Stablecoin Rule With Jan 18 Deadline for Issuers

Bottom line up front: The Office of the Comptroller of the Currency has finalized the first federal GENIUS Act stablecoin rule, and the message to issuers is simple – the statutory yield ban stays exactly as Congress wrote it, but the rewards debate just moved from blanket prohibition to case-by-case review. The rule takes effect January 18, 2027, the same day the GENIUS Act itself kicks in.

What the GENIUS Act stablecoin rule actually changed

The OCC released OCC Bulletin 2026-50 and News Release 2026-92 on October 21, with the rule published in the Federal Register on October 23. It lands as a new 12 CFR Part 15 covering reserves, redemption, risk management, reporting, licensing and custody – and it applies to federal and state qualified payment stablecoin issuers under OCC authority, plus foreign issuers seeking U.S. access.

Three provisions moved meaningfully from the March proposal, which drew roughly 328 comments:

  • Reserves: the daily liquidity requirement was cut from 10% to 5% of reserves, with the 12-month operational backstop retained.
  • Redemption: issuers must process redemptions within two business days, and the proposed automatic seven-day extension during redemption spikes was deleted. Instead, an issuer must notify the OCC within 24 hours once redemption requests exceed 10% of a brand’s outstanding value – the regulator decides whether an extension happens.
  • Yield: the OCC dropped its proposed rebuttable presumption that affiliate and third-party rewards violate the yield ban. Every program now gets judged on its facts.

The yield question everyone actually asked

This is the provision that decides whether exchange reward programs survive. The statutory ban on paying interest or yield solely for holding a stablecoin remains, but the OCC noted the word “solely” carries significant weight – a reward paid at least partly for other reasons may fall outside it. The American Bankers Association promptly observed that issuers can now provide economically equivalent yield while technically avoiding the prohibition, which is Washington-speak for “game on.”

There is no safe harbor: the OCC declined to presume that programs predating the GENIUS Act comply, and offered no examples. Markets are watching closely with PayPal’s PYUSD at 4%, Coinbase One USDC at 3.75% and Kraken’s USDG up to 4.5% in the field.

What happens next

From January 18, 2027, issuing a payment stablecoin in the U.S. without approval carries criminal penalties, with no phase-in for issuers already operating – though the application window cannot open until OMB approves the forms. The OCC expects roughly 22 issuers under its supervision; private forecasts cited in coverage project up to $378.8 billion of issuance in 2027. The Federal Reserve’s own GENIUS Act proposals remain open, and AML rules are being written separately with Treasury.

For context on how we got here, see our earlier coverage of the Treasury NPRM closing with 105+ comments. Treasury Secretary Scott Bessent called the framework “a watershed moment in American finance” – comparing it to the National Currency Act of 1863. The stablecoin industry now has 86 days to decide whether it agrees.
