French Stablecoin Tax Cleared 38-37, Extending 31.4% Levy to Crypto Swaps

France’s National Assembly has voted to fold stablecoin swaps into its flat tax regime, and the French stablecoin tax now heads to a full floor fight before December’s budget deadline. Lawmakers approved the amendment 38-37 on Friday, with 25 abstentions, after the finance committee had already blessed it on October 7.

The mechanics are simple, which is exactly why they matter: starting January 1, 2027, swapping bitcoin or any other cryptocurrency for a stablecoin classified as an electronic money token under the EU’s MiCA rules would count as a taxable event, taxed at France’s existing 31.4% flat rate. Today, that swap merely defers the bill until holders cash out into euros.

Also simple: the turnout. Only about 100 of 577 lawmakers participated in the vote — parliament’s version of a group project where 477 colleagues contributed vibes. The amendment, numbered I-3898 and led by MP Nicolas Sansu, still has real distance to travel.

How the French Stablecoin Tax Would Work

Under current rules, French crypto holders pay tax when they convert to fiat currency. Moving value into stablecoins has traditionally sat in the deferral gray zone — you left the volatility, but you had not left the system, so the tax stayed parked.

The amendment closes that door. A swap from crypto to a MiCA-classified e-money token becomes a disposal, exactly as if the holder had sold for euros and immediately bought back. In practice, that means:

  • A parking bill: sheltering in USDC or Tether during a downturn would trigger a 31.4% liability at the moment of the swap, not the moment of the exit.
  • Illustrative damage: swapping €10,000 of bitcoin for a stablecoin in 2027 would generate roughly €3,140 in tax — money the swap itself does not produce.
  • Strategy shock: DeFi routing and treasury habits built around stablecoin waypoints need rethinking before the new year.

In other words, the stablecoin stops being a tax-free waiting room and becomes a turnstile that charges on the way in.

The Long Road From Vote to Law

Here is the part that should keep celebratory Twitter threads honest: this is not law yet. The 2027 budget package still faces further legislative hurdles, and the finance committee rejected the budget’s revenue section 31-3 — a revolt that forces the crypto amendment to be resubmitted for debate in the full Assembly. Lawmakers have until December 10 to pass the budget.

That timeline gives opponents a window to dilute or drop the measure, and gives French holders a window to plan. Either way, the vote establishes intent: stablecoin swaps are now squarely in the taxable frame.

What It Means for Crypto Holders in France

France has never been short on crypto ambition — the same chamber previously rejected the digital euro while endorsing bitcoin and stablecoins — and now it wants the revenue side of that relationship written into the tax code.

For holders, three practical moves matter before January 1: map which 2027 swaps would become taxable events, model the 31.4% cost against the volatility being avoided, and watch the December 10 budget deadline, where a committee revolt already proves the text can still change.

The French stablecoin tax cleared its biggest hurdle with 38 votes to spare — one of them, literally. What happens in the full Assembly will decide whether Europe’s crypto-taxed country just wrote stablecoins into the ledger.
